Ocean City beach supervisor pleads guilty to sex with then-teen beach tag-checker

An Ocean City, New Jersey, beach supervisor and former city police officer has pleaded guilty to having sex with a then-17-year-old beach tag-checker whose job he had overseen, the Press of Atlantic City reports.

Charles Cusack, 52, of Egg Harbor Township, pleaded guilty on Monday to charges of second-degree official misconduct and fourth-degree sexual contact for having sex with her in 2012. The Press of Atlantic City reports that she alleges in a civil lawsuit filed against Cusack that the two had sex at his home and at the city's beach tag office.

Although the legal age of consent for sex in New Jersey is 16, that does not apply to adults who have a supervisory role over a teenager.

The Press reports that Cusack had rejected an earlier plea deal that would have spared him of potential incarceration but would have required that he register as a sex offender under Megan's Law.

Monday, he pleaded guilty with the understanding that the prosecutor will seek a probationary term with placement on the sex-offender registry.

Sentencing is set for Dec. 18.
