The deal to bring back A-Treat soda is offDavid Saba, with Lehigh Mining and Navigation, which represents hopeful owner Paul Eifler, told WFMZ.

According to Saba, A-Treat stopped communication with Eifler and refused to sign any paperwork. The two had a previous verbal agreement.

"I am extremely disappointed that the sellers did not follow through on our verbal agreement to purchase the A-TREAT brand and formulas," Eifler told WFMZ.

"As we moved through the negotiation process, several deadlines passed without any response. Nothing had changed on our end. In my opinion, the resulting inactivity has significantly damaged the value of the original agreement."

A-Treat owner Tom Garvey declined to speak with WFMZ.
